Judge Overrules Distribution of Californian Fracking Rights By US Bureau of Land Management

Wild LawA judge has ruled that the US Bureau of Land Management (BLM) “violated the law by distributing oil drilling rights before reviewing the potential risks associated with fracking”, according to an article on RT USA. US Magistrate Judge Paul Grewal found that BLM had not sufficiently reviewed the possible risks of fracking in California, the case “is largely viewed as a landmark victory by environmentalists who have been fighting against the procedures they fear might harm the environment.”

Cormac Cullinan’s firm, Cullinan and Associates, will be acting as counsel for the Treasure the Karoo Action Group who are taking the case against hydraulic fracturing (fracking) in the Karoo to the South African Constitutional Court. Cullinan is the author of Wild Law.

The Obama administration has broken the law, issuing oil leases across California without examining the risks of fracking. A federal judge ruled that the administration has “completely ignored” environmental concerns upon issuing the leases.

In response to a lawsuit filed by environmentalist groups, US Magistrate Judge Paul Grewal ruled that the US Bureau of Land Management (BLM) violated the law by distributing oil drilling rights before reviewing the potential risks associated with fracking.

Excerpt from Wild Law by Cormac Cullinan

Wild LawIn this excerpt from the second edition of Cormac Cullinan’s Wild Law, Cullinan explains that the current dominant understanding of the world is based on the false premise that “we humans are separate from our environment and that we can flourish even as the health of Earth deteriorates.”

Cullinan explains how studying law during apartheid helped him to understand how the law is used as a method of social control and “that there is not necessarily a healthy relationship between law, justice and morality.”

The human societies that presently dominate the world govern on the basis of a false understanding of the universe. The core falsehood is that we humans are separate from our environment and that we can flourish even as the health of Earth deteriorates.

In fact, we humans have convinced ourselves that human health and well-being depend on exploiting Earth (preferably as fast as technology permits and the market demands) rather than on preserving the global ecosystem. The governance structures, legal philosophies (jurisprudence), and laws established by many societies reflect and entrench the illusion of separation and independence. This encourages and legitimises environmentally and socially destructive behaviour and hinders the development of more appropriate forms of social organisation by those who do not subscribe to the dominant social myths.

Wild Law Update: Matt Damon’s New Movie Promised Land to Highlight Fracking Issue

Wild LawIn September this year the government lifted a 17-month-long moratorium against exploring shale gas reserves in the Karoo. Although no actual hydraulic fracturing will take place, some drilling as well as other “normal” geological exploration methods will be used to assist in shale gas exploration.

The Times reported that government maintain that banning “fracking”, as it is widely referred to, will bring forth the loss of a major economical opportunity.

Only “normal” geological exploration will be allowed, the government’s multi-disciplinary task team said in a report, the executive summary of which was released by Mineral Resources Minister Susan Shabangu in Cape Town.

News24 also reported on both AfriForum and the Freedom Front Plus condemning the decision whilst the DA advised the government to approach this sensitive issue with the utmost caution.

There has been mixed reaction to Cabinet’s decision, announced on Friday, to lift a moratorium on applications to explore for shale gas in the Karoo.

With a number of laws and regulations to take into account, so that all parties with vested interests are kept abreast of the legal ramifications, as well as the safety of the Karoo is looked after, a book like Cormac Cullinan’s Wild Law gives some clarity into the situation. Wild Law weaves politics, legal theory, quantum physics and ancient wisdom together to unpack the human species’ environmental role on Earth today.

Also highlighting the troubles fracking could cause is Matt Damon’s latest movie, Promised Land, which will be screened at the Berlin Film Festival next year:

Matt Damon’s film about the controversial shale gas industry is to screen in competition at the Berlin International Film Festival.

Promised Land, directed by Gus Van Sant, centres on a natural gas salesman who experiences life-changing events after arriving in a small town.
